This right of access is subject to certain exemptions contained in Part IV of the FOI Act.
You also have a right to ask for information that Comcare holds about you to be amended if it is incomplete, out of date, incorrect or misleading.
All decisions made under the FOI Act must be made by an authorised decision maker.
If you have lodged a claim for Workers' Compensation you are entitled to request access to any document held by Comcare that relates to your claim under section 59 of the Safety, Rehabilitation and Compensation Act 1988 (SRC Act).
You do not need to request access to documents relevant to your claim under the FOI Act. You can request documents under section 59 of the SRC Act as opposed to under the FOI Act.
